Booking Terms and Conditions


1. Introduction


These Booking Terms and Conditions ("Terms") are applicable to travellers ("you" or "Traveler") who book journeys ("Journey") through the Safari Culture platform ("Platform"). By booking a Journey through our Platform, you agree to comply with and be bound by these Terms, along with any additional terms and conditions set forth by the respective tour operators ("Tour Operator"). These Terms ensure a fair and transparent process for both Travelers and Tour Operators.


2. Booking Process


2.1 Booking Requirements


2.1.1 Eligibility: To book a Journey, you must meet any requirements set by Safari Culture and/or the Tour Operator, such as completing any verification processes.


2.1.2 Fees and Charges: All applicable fees, including the Journey Fee, Security Deposit (if applicable), and any applicable Taxes (collectively, “Total Fees”) will be presented to you prior to booking a Journey. You agree to pay the Total Fees for any booking requested in connection with your Safari Culture Account.


2.1.3 Payment: Safari Culture Payments will collect the Total Fees at the time of the booking request or upon the Tour Operator’s confirmation pursuant to the Payments Terms. For certain bookings, you may be required to pay or have the option to pay in multiple installments.


2.2 Booking Confirmation


2.2.1 Agreement Formation: Upon receipt of a booking confirmation from Safari Culture, a legally binding agreement is formed between you and the Tour Operator, subject to any additional terms and conditions of the Tour Operator that apply, including the applicable cancellation policy and any rules and restrictions specified in the Journey.


2.2.2 Additional Travelers: If you book a Journey on behalf of an additional Traveler, you must ensure that every additional Traveler meets any requirements set by the Tour Operator, and is made aware of and agrees to these Terms and any terms and conditions, rules, and restrictions set by the Tour Operator. If you are booking for an additional Traveler who is a minor, you represent and warrant that you are legally authorized to act on behalf of the minor. Minors may only participate in any Journey if accompanied by an adult who is responsible for them.


2.2.3 Group Payments: Safari Culture may enable a Traveler who is booking a Journey on behalf of one or more additional Travelers to split the payment of the Total Fees for an eligible booking on a pro-rata basis between the Organizer and at least one other additional guest (each a “Co-Payer”). To participate in the Group Payment Service, each Co-Payer must have or register a Safari Culture Account prior to making a payment.


3. Cancellation and Refund Policy


3.1 Standard Cancellation Terms


3.1.1 Deposit: A deposit of 25% of the total Journey cost is required before bookings are confirmed.


3.1.2 Full Payment: Full payment of the total Journey cost is required 60 days prior to the travel date.


3.1.3 Cancellation Charges:

  • Cancellation notice received more than 60 days prior to travel date: No Cancellation Charge.
  • Cancellation notice received 30-60 days prior to travel date: Cancellation Charge = 50% of total invoice.
  • Cancellation notice received less than 30 days prior to travel date: Cancellation Charge = 100% of total invoice.

4. Force Majeure Cancellations


4.1 The Tour Operator may cancel a Journey at any time up to departure if, due to terrorism, natural disasters, global pandemic, political instability, or other external events, if it is not viable for them to operate the planned itinerary. If the Tour Operator cancels your Journey, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside the Tour Operator's reasonable control, refunds will be less any unrecoverable costs. The Tour Operator is not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance excess, or non-refundable flights.


5. Booking Amendments


5.1 If you wish to transfer from one Journey to another or transfer your booking to a third party, you must notify the Tour Operator at least 90 days prior to the proposed departure date. A fee per person per change will apply (in addition to any charges levied by hotels, ground operators, or airlines). If you notify the Tour Operator less than 60 days prior to the proposed departure date, the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the Journey, and transfers to another departure can only be made to a departure within the current validity period.


5.2 Amendments to any other arrangements made in conjunction with your Journey will incur an administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators, or airlines.


6. Prices and Surcharges


6.1 Pricing Basis: Prices are based on current rates of exchange, tariffs, and taxes. The Tour Operator reserves the right to increase Journey prices to cover increased costs, tariffs, and taxes, and to reflect fluctuations in foreign exchange markets.


6.2 Itinerary Changes: The Tour Operator reserves the right to withdraw a Journey or any part of it, make such alterations in the itinerary or with the Journey inclusions as deemed necessary or desirable, and pass on to Journey members any expenditures or losses caused by delays or events beyond their control. Every effort will be made to operate Journeys as planned, but alterations may occur after the final itinerary has been issued.


6.3 Variable and Seasonal Pricing: Our Journey prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our Journey prices may vary at any time in accordance with demand, market conditions, and availability. The Tour Operator will make every effort to provide the most up-to-date Journey pricing.


6.4 Surcharges: The Tour Operator reserves the right to impose surcharges up to 60 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action requires them to do so. In such instances, the Traveller may cancel the booking within 14 days of notification of the surcharge and obtain a full refund.


6.5 Payment Methods: Please note that a surcharge may be applied to all purchases made by credit card.


7. Traveler Responsibilities


7.1 Compliance


7.1.1 Terms and Conditions: By booking a Journey, you agree to comply with these Terms and any additional terms and conditions, rules, and restrictions set forth by the Tour Operator.


7.1.2 Accuracy of Information: You must ensure that all information provided to Safari Culture and the Tour Operator is accurate and complete.


7.2 Conduct


7.2.1 Behaviour: You must conduct yourself in a respectful and lawful manner during the Journey. Any behaviour deemed inappropriate by the Tour Operator may result in the termination of your participation in the Journey without refund.


7.3 Health and Safety


7.3.1 Fitness for Travel: You are responsible for ensuring that you are in good health and fit to travel. Any health issues or concerns should be communicated to the Tour Operator in advance.


8. Liability


8.1 Safari Culture Liability


8.1.1 Platform Provision: Safari Culture acts as an intermediary between Travelers and Tour Operators. Safari Culture is not responsible for the conduct of Tour Operators or the quality of the Journeys provided.


8.2 Traveler Liability


8.2.1 Damages: You are responsible for any damages caused by you during the Journey. Any costs incurred by the Tour Operator as a result of such damages will be charged to you.


9. Dispute Resolution


9.1 Complaints


9.1.1 Resolution: If you have any complaints about a Journey, you should first attempt to resolve the issue directly with the Tour Operator. If the issue cannot be resolved, you may contact Safari Culture for assistance.


9.2 Mediation


9.2.1 Mediation Process: Any disputes arising from these Terms or your booking of a Journey will be resolved through mediation before seeking any other form of resolution.


10. Passport and Visas


10.1 Traveler Responsibility: You must carry a valid passport and have obtained all of the appropriate visas, permits, and certificates for the countries which you will visit during your Journey. Your passport must be valid for six months beyond the duration of the Journey. It is your responsibility to ensure that you are in possession of the correct visas, permits, and certificates for your Journey; please refer to the itinerary for details. The Tour Operator is not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.


11. Travel Insurance


11.1 Mandatory Requirement: Travel insurance is mandatory for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses, and emergency repatriation. We also strongly recommend it covers cancellation, curtailment, personal liability, and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your Journey; you will not be able to join the Journey without it.


13. Severability


13.1 In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.


14. Privacy Policy


14.1 Any personal information that we collect about you may be used for any purpose associated with the operation of a Journey or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers, or other suppliers to enable us to operate the Journey. We will otherwise treat your details in accordance with our privacy policy.


15. Applicable Law


15.1 The laws of the state of Delaware, United States govern these Booking Conditions to the fullest extent allowable.
